Q: The burden of misunderstanding rests with whom?

A: A learned treatise offers:

• Do both parties know or have reason to know the meaning attached by the other? (Then both are at fault.) 

• Does 1 party know or have reason to know that the other neither has nor has reason to attach any different meaning? (Then 1 is to blame, 1 innocent.)

• Does neither party know? (Then both are blameless.) 

Relatedly, the scholars broach the prickly question, "What is 'chicken'"?

These principles remain useful to TiR today, to navigate our frequent and apocalyptic misunderstandings about chicken.
